Pendency

If your case proceeds to an impartial hearing for private school reimbursement and you win on the merits, and it stays won, your child will have pendency at the private school he or she currently attends. ⚫️What does this mean? It means that, if you decide to sue your school district for the next school year, the school district is obligated to fund the private school so that your child can remain in the private school and “stay-put” while the litigation is pending. ⚫️This is one of the most important benefits your attorney can achieve for you (by the way, you will NOT get the benefit of pendency if you simply settle your case).
