Recording your IEP meeting

“When it comes to recording your IEP meetings, the laws differ by state about whose consent you need to do so. In New York, you only need one party’s consent to record your meeting, meaning that you do not need to inform the District of your plan to record. However, in other states, recording your IEP meeting without the consent of all parties to the conversation may be illegal.

So, if you are a New York State resident and are planning to participate in your IEP meeting from outside of New York—whether that be because you temporarily relocated out-of-state due to COVID-19, or for any other reason—you must be aware of the laws of the state in which you are physically located when participating in your IEP meeting before you record it.

Thus, if you plan to participate in your New York State IEP meeting from out-of-state, ask your attorney about what steps you must take in order to legally record your meeting from your out-of-state location.”
