Once your attorney files a Due Process Complaint on your behalf, which initiates an action against your school district, it is then up to your school district to decide whether it will pursue settlement of the case or proceed with litigation. What happens if your case is referred for settlement?
If your case is referred for settlement, your attorney will be in touch with you to gather all the required settlement documents for submission to your school district. Once the documents have been submitted, the school district will offer a settlement figure, and negotiations will ensue.
